Response to NYT’s report on Justice Department not taking action on Biden’s Autopen Case

FOR IMMEDIATE RELEASE

March 4, 2026

Washington, D.C.– The Oversight Project issued a response to a New York Times article, Justice Dept., Under Pressure From Trump, Fails to Build Autopen Case Against Biden, expressing disappointment at reports that the Department of Justice has closed a criminal investigation led by the U.S. Attorney’s Office for the District of Columbia into autopen use by the Biden White House.

President Trump has made it clear that any pardons and commutations made by the Biden Autopen are null and void of no other force or effect. House Committee on Oversight & Reform Chairman James Comer’s investigation clearly established that there is no evidence that President Biden authorized–or even knew about–some of the most controversial autopened actions of his Administration. The same is true of an internal review by the White House Counsel’s Office.

Despite all of this, it appears that DOJ has closed an investigation without digging into the mountain of available paper and actually bringing in responsible parties to testify before a grand jury about why an autopen ran the country. Despite discovering a mountain of evidence related to the “scandal of the century,” the Oversight Project was not contacted in relation to this supposed criminal investigation.

The Oversight Project yet again urges DOJ to take action.

Oversight Project President Mike Howell stated:

“The clock is ticking on accountability.  Every day that goes by makes it harder for the Department of Justice to make good on one of the President’s signature campaign promises.  We will wait for the Department of Justice to weigh in before taking the word of the New York Times, who is better known for sudokos and bum steers than for accurate reporting.  Recall that the New York Times initially called our bombshell discovery of the autopen usage a “conspiracy theory” and then months later admitted it was true in their reporting which included an interview with Joe Biden admitting to everything.  While we had a solid victory on this front last week with Florida officials re-arresting an autopen criminal, we still wait on bated breath for action from the Department of Justice.  We can’t wait forever.”
