

Oversight Project Sues to Block Proposed Maryland Redistricting Constitutional Amendment

Washington, D.C.—The Oversight Project, a proud member of the Mass Deportation Coalition and leader of Redistricting and Election Protection for American Integrity and Representation (REPAIR) Initiative, has filed a lawsuit in Maryland challenging HB 2100. HB 2100 is the recently-passed measure that puts a proposed amendment to the Maryland Constitution on the November ballot that asks voters whether the state constitutional compactness and boundary rules should apply exclusively to General Assembly districts rather than federal congressional map.
If approved, the amendment would overturn a 2022 state court ruling that Maryland’s constitutional requirements for compact, adjoining, and county-line-respecting districts applied to congressional districts. In practice, approving the amendment would allow Maryland Democrats to draw a new congressional map mid-decade that wipes out the sole Republican in the Maryland congressional delegation.
Governor Wes Moore called the Special Session in response to the Supreme Court’s landmark ruling in Louisiana v. Callais, which outlawed drawing congressional districts on the basis of race. Maryland Democrats are using this brazen and unlawful power grab to set the stage for an 8-0 congressional delegation that not only includes illegal districts drawn on the basis of race, but will be filled by open border zealots who will put illegal aliens before the American people. Illegal aliens should absolutely not be counted for the purposes of apportionment of congressional districts. This leads to politicians putting the interests of foreigners before Marylanders.
Maryland Democrats broke the law in the Special Session. They ignored bright line dates and deadlines and legislative rules to force the ballot measure on the citizens of Maryland. Maryland Democrats violated the due process rights of all Marylanders, among other legal violations.
The Oversight Project is proud to bring this suit alongside members of the Maryland Freedom Caucus and Members of the Maryland Senate. As Maryland voters, each has been harmed by the process that occurred in Annapolis during the Special Session.
Oversight Project President Mike Howell offered the following statement:
"Maryland can be great again but not if the plan is to turn the Eastern Shore into Baltimore and Prince George's County. The Governor and his radicals want to impose insane policies on the good people of the Eastern Shore through extinguishing their congressional representation. There's a reason why the Eastern Shore is more beautiful and happy than the crime dens around other parts of Maryland. The people deserve representation to keep it that way instead of following the path of Mandami, El-Sayed, Ocasio Cortes and the other communists that Governor Wes Moore is trying to catch up to as he readies his run for President.
Moore has made a crucial mistake in his power grab and along with members of the Maryland Freedom Caucus we are going to hold him accountable. We will Save the Bay, because there is no saving the Bay if the communists take total control."
Delegate Matt Morgan, Chairman of the Maryland Freedom Caucus added:
“Annapolis Democrats spent taxpayer dollars on a Special Session for one reason: to rewrite the Maryland Constitution and eliminate the last remaining Republican congressional seat. Like a banana republic, they suspended the rules, ignored statutory deadlines, and treated the Constitution as an obstacle to be removed. Our Declaration of Rights exists to protect the people from politicians who undermine free and fair elections. We are taking them to court to uphold these principles.”
Maryland Freedom Caucus Vice-Chair Delegate Kathy Szeliga stresses:
“Four years ago, I was the lead plaintiff when Judge Lynne Battaglia struck down the Democrats’ extreme partisan gerrymander. Today, the Maryland Freedom Caucus is once again leading the fight to stop them from changing the rules midstream. The process matters. We will not let them rewrite the Constitution on a rushed, defective timeline and without due process.”
