Oversight Project Sues for Disclosures Related to Obama-Era Targeting of “The Holy Grail” of American Innovation

Washington, D.C.– The Oversight Project filed a lawsuit on behalf of ParkerVision Inc. seeking documents related to Obama-era targeting of the company. This matter relates to a long dispute over revolutionary, American-made technology, referred to as “the Holy Grail,” suspiciously being absorbed by a major company with significant Chinese connections: Qualcomm. This technology, and derivatives, have appeared on the Chinese market.

The Oversight Project is concerned about the United States’ lackadaisical approach to dealing with sustained Chinese communist intrusions into our economic, political, and national security spheres. These concerns are heightened in areas where our politics are weakest. The American political system is weak when deep-pocketed special interest lobbies have more political power than everyday Americans.

Mike Howell, Oversight Project President, gave this statement: “ParkerVision’s story is an American story, and that is why we are thrilled to sue for them. We stand with everyday Americans against politically powerful special interest lobbies and understand that for America to have a Golden Age then China cannot be eating our lunch. For America to be great, Americans have to be able to build great things here. That spirit of innovation is fading, and the government is not helping by allowing American creations to be taken by the Chinese and their multinational corporate allies and lobbies.

It shouldn’t have to come to a lawsuit like this to know what the Obama White House was doing by focusing on ParkerVision on the eve of a visit to a major donor from Qualcomm and at a pivotal moment in litigation. The government has admitted that responsive documents about Obama White House web traffic on this exist, so we just want to see them. We honestly shouldn’t even need to litigate, so hopefully they are produced. It is about Obama after all.

Perhaps there is an innocent explanation for such suspiciously timed and consequential conduct from the Obama White House, but withholding these documents indicates there could be something much more behind the curtain. I don’t put anything past the Obama Administration given their track record of weaponization and their coziness with foreign and multinational corporate interests. It’s all very suspicious.”

Jeff Clark, Oversight Project Vice President President of Litigation, gave this statement:

“ParkerVisions’s FOIA, Presidential Records Act, and Administrative Procedure Act claims against the Archives are strong. ParkerVision and the American people deserve to learn why the Obama Administration was so darned interested in a case aimed like a dagger at homegrown and focused American innovator ParkerVision in order to allow technology to escape our borders and be usurped by China.”

Marshall Yates, Oversight Project Strategic Counsel, gave this statement:

“The days of deep state bureaucracies obstructing FOIA requests must not continue. That is why we’ve filed this case on behalf of ParkerVision Inc. because they have waited too long to receive the FOIA records that they are due.”

Background:

ParkerVision, Inc. is currently engaged in protracted federal patent infringement litigation against Qualcomm, Inc. Following a 2013 jury verdict of $173 million in ParkerVision’s favor, the presiding judge overturned the verdict in June 2014 (within six weeks of telling the parties an on-going royalty would be awarded if one was not negotiated). This coincided with documented visits to ParkerVision’s website from an Executive Office of the President (EOP) IP address (May 19, 2014) and the founder and CEO of Qualcomm hosting President Obama at his home for a DNC fundraiser (May 8, 2014). ParkerVision suspects that the Obama Administration may have interfered in this litigation, potentially vitiating due process and wasting judicial resources. Qualcomm’s founder also provided high levels of funding for the Obama Library’s parent entity in Chicago.

Qualcomm has been involved in offshoring key wireless and cellular technology to China, employs 1000’s of R&D engineers in China, has invested in at least 40 Chinese technology companies, and was sanctioned in 2016 by the SEC for corruption involving China.

Chinese communist influence in the United States of America is everywhere:

  • Documents recently released by the Trump White House show massive election integrity intrusions.
  • Eric Swalwell, a former member of the House Permanent Committee on Intelligence, was proven to have been “honey potted” by a Chinese spy and to have been allowed to place CCP interns in government offices.
  • The CCP spies have been identified in the staff of multiple Congressmen and Senators, including in Senator Dianne Feinstein’s employ, for decades with little response from national security officials.
  • China has been proven to exploit the United States through birthright tourism. See Ending Birth Tourism, Executive Order (Aug. 6, 2026).
  • Many Top U.S. universities have become the preferred training grounds for the CCP elite, and have been co-opted into self-censorship regarding the threat of the CCP while promoting a controlled transition of global primacy to the CCP.
  • U.S. scientists charged with investigating COVID-19 privately acknowledged the likelihood of a laboratory origin for the virus was downplayed to satisfy the interests of the Chinese government.
  • The key agencies in the U.S. intelligence community delayed updating their assessment of the origin of COVID-19 for years until overwhelming public evidence and changes in presidential administration made the previous willful dismissal of clear conclusions untenable.
  • Former top U.S. officials including a former CIA Director have been paid by Chinese influence operations and faced no consequences.
  • 51 former top National Security Officials misled American citizens about the compromise of the family of a presidential candidate by Chinese military intelligence officers, despite the national security establishment possessing contemporaneous evidence which authenticated this compromise.
  • The FBI initiated Operation Round River to protect Biden family corruption in Ukraine and China, labeling such allegations “Russian disinformation.”

This abuse is also in our patent system and it threatens the ability of America to innovate. The Oversight Project is bringing the case not only to recover documents that belong to the American People in the first place, but to challenge our political leaders to finally take the threat of Communist China seriously, even when it is attached to donors, entangled economic interests of the powerful, and former President Obama.

Despite narrowing the scope of these requests and asking for records to be provided on a rolling basis, the Archivist has yet to provide any records or notice of any decision as to whether it will comply with the records request to ParkerVision. This has resulted in an effective denial that hinders ParkerVision’s ongoing legal discovery.
