Oversight Project Lays Out Plan to Respond to Disastrous Supreme Court Ruling on Birthright Citizenship
FOR IMMEDIATE RELEASE
June 30, 2026
Washington, D.C.– The Oversight Project shares the disgust of patriotic Americans in their reactions to today’s Supreme Court decision affirming that the anchor babies of illegal aliens are given citizenship for being born on American dirt. Illegal immigration has wreaked havoc on the United States and today’s decision gives a massive reward to the anti-American left who seek to undermine our country. Despite this massive loss, there is still much that the Trump Administration can do to reduce the damage by committing to an aggressive enforcement agenda. The Oversight Project is providing those plans to the Administration in hopes that from the ashes of defeat, we can still find a path to saving America.First, the Oversight Project is releasing the Keeping Families Together Plan: How to Deport after the Birthright Citizenship Case which, in part, calls on the Trump Administration to make deporting the illegal alien parents of anchor babies an absolute priority. Simply put, if an illegal alien is expecting to give birth, gives birth, or has given birth to a child on U.S. soil then they should be deported and take their family with them, regardless of the ill-gotten citizenship of that child. This is the same enforcement framework that should have already been underway even if the case had been rightly decided today. This prioritization will help President Trump achieve his signature campaign promise to conduct the largest deportation operation in American history. This would be a focus on quantity as opposed to the previous enforcement framework of focusing on “worst of the worst” so-called criminal illegal aliens. We should no longer wait for illegals to commit crimes before they are deported.

Second, through our REPAIR Initiative, we are advocating for prioritizing the need to have an accurate Census in 2030 that does not count illegal aliens or foreign nationals in determining representation in government. Coupled with our aggressive efforts to engage in redistricting battles across the country, strict immigration enforcement, and sensible Census reform, America could have a golden era of actual representative self-government as opposed to the artificial inflation of far-left elected power through dirty tricks.
As a proud member of the Mass Deportation Coalition, the Oversight Project will continue to push for all policies that make sure America is for lawful Americans and their descendants only.
Oversight Project President Mike Howell gave this statement:
“My country is more than a pile of magic dirt. While the Supreme Court may consider anchor babies of illegal aliens to be citizens, they are not my countrymen. Citizenship means something more than jumping a border and having a baby while here illegally. The Oversight Project is ready to assist the Trump Administration in all ways to mitigate the harm caused by today’s Supreme Court decision. America needs to mass deport illegals here and limit visas, so that there aren’t opportunities for anchor babies to be born and receive ill-gained citizenship. Parents and would-be parents of anchor babies should be deported so that the families can remain together in their home country. This is the common-sense, safe, orderly, and humane way to respond to this crisis. It is also the way to make sure America is great, because America cannot be great while suffering from the consequences of unchecked mass illegal immigration.
America cannot be great when a communist billionaire in China can ship his sperm to women in California so that he can have American citizen children and then reap the benefits associated with that. I wish I did not have to write that sentence, but our Supreme Court has given me no choice.”
Oversight Project Vice President of Litigation Jeff Clark gave this statement:
“The Constitution is both a functional document yet one designed to attain legal stability. The majority opinion errs both by ignoring the functional nature of our national charter (allowing it to be circumvented) and by radically fomenting legal, political, and cultural instability.
The pro-citizenship-as-soil-birth approach that animated Eighteenth Century Britain is not our problem in Twenty-First Century America. The Supreme Court and the Reconstruction Congress rightly rejected Dred Scott to ensure that black slaves and their descendants were American citizens. We also evolved to give Native Americans full U.S. Citizenship, but the North American States of our country was also their country of birth. We could have preserved those wins without allowing foreign invaders to claim citizenship rights by birthing their children inside our borders.
This decision will dramatically destabilize the American body politic and our distinct culture. It is a massive win for the political party that seeks to import voters from foreign nations unfamiliar with our institutions, our laws, and our habits – because it can no longer persuade the majority of native-born Americans to vote for them.
We have flung open our gates to foreign NGOs strategizing against us and turned a blind eye to efforts by Communist China, through their intermediaries and Latin American communist governments, to nudge foreign invaders north across the Rio Grande to overwhelm our generous social safety net, plunging us further into debt. We have also flung open our gates to Communist Chinese birth tourism, which would have been unthinkable to me just 10 years ago. Today, I weep for our nation, and that is no exaggeration.”
Oversight Project Strategic Counsel Marshall Yates gave this statement:
“As we prepare to celebrate the 250th anniversary of our independence, the Supreme Court has devalued American citizenship to mere proximity at birth. Our founders put their lives on the line for liberty and self-government — not for the Supreme Court to bestow citizenship rights on the children of illegal aliens and temporary visitors merely because of the lawless presence of their mother at the moment of birth.
This ruling will have profound ramifications for decades to follow. The Supreme Court just affirmed the left's open borders agenda, one set on diluting our nation's citizenship and heritage. The liberal wing of the Supreme Court slammed the door shut on any check against the theft of citizenship by foreign visitors and illegal aliens — who are encouraged to sneak into our country by the left's thirst for political power. Sanctuary States know they can use these anchor babies to boost their political power in the next census by encouraging an influx of foreign nationals to come here and create citizenship status through their newborn children.
Be warned: America should be prepared for swarms of illegal aliens to continue their invasion of our country. This open borders lawlessness will continue to be championed by blue states as a way to offset their declining populations — populations shrinking as Americans flee their failed socialist policies — to avoid losing political power through the next census and the allotment of electoral representation.
The Trump Administration has the opportunity to counter the left’s thirst for political power in the upcoming Census. First, President Trump should immediately nominate an America First Director at the U.S. Census Bureau. Then the President should sign an Executive Order explicitly excluding illegal aliens and foreign nationals from the Census’ apportionment count.”
Oversight Project Visiting Fellow for Deportation Studies Scott Mechkowski gave this statement:
“I spent two decades enforcing this nation’s immigration laws because I believe in our sovereignty and the rule of law. I’m disappointed the Supreme Court sees it differently but the remedy is clear, enforce the law and remove those here illegally, mass deportations is not an option.”
