Oversight Project Files Motion for Summary Judgment in Case to Block Proposed Maryland Redistricting Constitutional Amendment

Washington, D.C.–The Oversight Project, a proud member of the Mass Deportation Coalition and leader of Redistricting and Election Protection for American Integrity and Representation (REPAIR) Initiative, has filed its motion for summary judgment in its Maryland lawsuit challenging Maryland challenging HB 2100. The case is in the Circuit Court for Anne Arundel County. Reply briefs are due on August 21, 2026 and oral argument is set for 10:00 AM on August 25, 2026.

The Oversight Project filed the suit on behalf of our President Mike Howell, members of the Maryland Freedom Caucus, and state senators, each in their personal capacity. The suit seeks to stop the unlawful power grab by Governor Wes Moore and Maryland Democrats to wipe out the sole Republican remaining in the Maryland congressional delegation and send another open borders extremist to Washington.

Our brief lays out the multiple ways Maryland Democrats broke the law in the Special Session. We highlight how they ignored bright-line dates for implementation, statutory deadlines, and constitutional restrictions all to unlawfully force the ballot measure down the throats of the citizens of Maryland. For instance, Maryland Democrats violated the due process rights of all Marylanders, stripping them of important legal and factual context and the full range of voter information needed to understand a highly complex constitutional amendment proposal, obscuring its true meaning and impact from the people.

Oversight Project Strategic Counsel and leader of the REPAIR Initiative Marshall Yates offered the following quote:

“This filing is a major step in this rapid litigation. Ultimately this case will come down to whether Governor Moore and his General Assembly are allowed to ignore Maryland’s newly passed elections laws to fast track this highly partisan constitutional amendment.

We do not believe the courts should condone this lawlessness from the Governor and the General Assembly by expanding their power to mislead voters to pass this constitutional amendment by an unconstitutional process. Fair and free elections in Maryland cannot be excused as politically inconvenient merely because Governor Moore has presidential ambitions that force him to pander to the democrat’s socialist open borders base.”
