Oversight Project Files Amicus Brief in Support of Peter Navarro

Washington, D.C.– The Oversight Project today filed an amicus curiae brief in support of Dr. Peter Navarro, one of President Trump’s closest advisors during the first Trump presidency and again during his second term of office.
Peter Navarro filed last week for what is known as rehearing en banc — further review of an appeal by the entire complement of Judges, not just a panel of three Judges — in the U.S. Court of Appeals for the District of Columbia Circuit, captioned United States of America v. Peter Navarro, No. 24-3006.
The Oversight Project is a non-profit litigating organization supporting, among other core American principles, a Bill-of-Rights-based policy for the entire Executive Branch that whenever, during the course of administering the programs of any Executive Branch department or agency, there appears to be a statutory ambiguity, such ambiguity shall be construed in favor of “powers . . . reserved to the States respectively, or to the people” (U.S. Const., amend. X). The Tenth Amendment operates under this guiding principle from the U.S. Supreme Court: “The question is not what power the Federal Government ought to have but what powers in fact have been given by the people.” Guided by this and all constitutional principles, we work tirelessly to expose any abuses of these powers by federal government officials.
According to The Oversight Project’s Director of Litigation Jeff Clark: “This case is about separation of powers and a huge ambiguity in a federal criminal statute weaponized during the Biden Administration, resulting in Dr. Peter Navarro, one of the closest advisors to President Trump during his first term, being put in leg irons at the airport and eventually imprisoned without being able to present to the jury any defense based on his good-faith belief that President Trump had invoked Executive Privilege to protect the candid counsel he received from Dr. Navarro. This Court should grant rehearing en banc to address the exceptionally important issues we lay out.”
