Howell v. Moore Update: Oversight Project Files Brief with Maryland Supreme Court for Redistricting Litigation

Washington, D.C.–Today, the Oversight Project, a proud member of the Mass Deportation Coalition and the leader of Redistricting and Election Protection for American Integrity and Representation (REPAIR) Initiative, filed its brief with the Supreme Court of Maryland for Howell v. Maryland. Oversight Project attorneys will appear in the Maryland Supreme Court on Thursday, September 3, 2026 with oral arguments scheduled to begin at 9 AM.
The Maryland Board of Elections and collection of other state actors appealed to the Maryland Supreme Court after Anne Arundel County Circuit Court Judge Thompson ruled in favor of the Oversight Project last week.
The Oversight Project is proud to represent members of the Maryland Freedom Caucus and members of the State Senate in this case–all in their individual capacity as Marylanders. Maryland Democrats broke the law during their Special Session. They focus on one constitutional provision, violated others, and ignored bright-line statutory deadlines that they themselves created. Their constitutional violations, if not checked, will prevent Maryland voters from fully understanding the questions presented to them on their ballots in November. After securing a victory in the Circuit Court, the Oversight Project is now prepared to defend that ruling before Maryland’s highest court.
Oversight Project Strategic Counsel and Leader of REPAIR Marshall Yates gave this statement:
“Our brief is very compelling because we have the facts and the law on our side. The facts are clear; the Oversight Project caught Governor Moore and his supermajority in the Maryland General Assembly missing deadlines and writing intentionally misleading language for this ballot measure. We are excited for our chance to be heard before the Maryland Supreme Court on Thursday. Protecting voters from unconstitutional ballot schemes and forcing election officials to follow the law is a critical element of the Oversight Project’s REPAIR Initiative.”

“I am locked in on preparing for oral argument right now. My focus will be on rebutting the State’s excuses for violating Maryland’s Constitution and election statutes by answering the questions of the Court. That is where I will speak to the complex details in this case.”

“This case is pretty simple: Hakeem Jeffries went to Annapolis and goaded Governor Wes Moore and Democrats in the General Assembly into a rushed redistricting process that blew past obvious deadlines and racked up a slew of other clear defects. Jeffries has declared “maximum warfare” and was behind a similar loss in Virginia. Jeffries was under immense pressure and very emotional so he turned the screws on the Maryland politicians, including Governor Moore who wants to run for president. Too many politicians were blinded by raw politics and forgot about the law and rights of Marylanders, even though some realized that this was a terrible idea. The Oversight Project did not forget about the law and rights of Marylanders and I’m confident the Maryland Supreme Court won’t either.”
