Oversight Project’s Statement on the Pardoning of the 2020 Electors

Washington, D.C. — The Oversight Project has long believed that prosecutions of individuals who engaged in good-faith challenges to the 2020 Election were an abomination. Legal and political contests of elections, a feature of our system since its foundation, suddenly were a bug. Accepted legal positions consistently taken by both parties since the third Presidential Election suddenly became so dubious that they were sanctionable or even criminal. On the basis of this vindictive absurdity, the left did their best to destroy their political enemies.
President Trump’s bold Pardons once again restore the norm and fight back against weaponization.
There are two critical points to remember about these pardons:
First. They are not an admission of guilt. Pardons normally do imply guilt, but these are expressly pardons of innocence. That means the pardons were issued to emphatically end the unjust prosecutions of those who are innocent.
Second. Make no mistake, although these pardons are federal, they drive a heart through abusive state prosecutions. Questions of federal elections turn on federal law, and these pardons make clear that the individuals in question followed federal law. Moreover, these pardons make clear that the United States Government, as a matter of fact, does not believe that any of these individuals acted with criminal intent. That dooms the prosecutions.
The Oversight Project led the charge on these issues, working behind the scenes to push for these pardons and to ensure the exhaustive legal legwork was done in the background. Countless hours were spent ensuring the legal case for these pardons was airtight—poring through reports of Congressional debates and cases from the start of the Republic. Pardon Attorney Ed Martin’s leadership on this issue has been heroic. He worked tirelessly to explain not only that these pardons were justified, but to carefully address legal issues and ensure they were optimized in this complicated legal and political environment. Well done, all! Another small piece of weaponization bites the dust.
