Distinguished Constitutional Fellow Joseph Schmitz joins Amicus Brief in Support of Jeffrey Clark

Distinguished Constitutional Fellow Joseph E. Schmitz, former Inspector General of the Department of Defense, has joined eight other attorneys in filing an amicus brief before the D.C. Court of Appeals in support of former Assistant Attorney General Jeffrey Clark. The brief argues that disciplinary action against Clark for a draft, unsent letter raises serious constitutional and First Amendment concerns.

Schmitz and his fellow amici emphasize that no false statement was ever issued, that Clark’s conduct fell within legitimate internal policy debate, and that politically motivated disciplinary actions threaten the independence of government attorneys and the rule of law.
