Oversight Project Clears CBP Officer Involved in Split Second Deadly Force Decision in Minneapolis

Washington, D.C.– Taking into account the available evidence, the Oversight Project has cleared the Customs and Border Patrol (CBP) officer involved in the shooting of Alex Pretti. Drawing on over 60 years of law enforcement experience and former intelligence agents, the Oversight Project determined that the CBP officer was legally justified in his actions. The Oversight Project is prepared to aid the CBP officer with any legal issues that may arise. 

In this split-second decision, the CBP officer made the decision to fire his weapon based upon the totality of the circumstance which included the belief that Alex Pretti possessed a firearm. Furthermore, federal agents are trained to eliminate the threat until it is neutralized. Federal law enforcement officers are immune from state criminal prosecution when they act within the scope of their authorized duties. Based on the evidence, the officer acted well within his scope of federal authority and his actions were justified under the circumstances.
